Student Code of Conduct - Racial Harassment 06-07
Racial Harassment shall mean verbal or physical behavior on the basis of race that is so
severe, pervasive, and objectively offensive that it bars the victim’s access to an educational
opportunity or benefit or alters the conditions of the victim’s employment and creates an abusive
working environment.

Fayetteville State University subscribes to the following Equal Employment Opportunity
Commission (EEOC) definition of sexual harassment:
Unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a
sexual nature constitute sexual harassment when:

3. such conduct has the purpose or effect of unreasonably interfering with an individual’s work
performance, academic activities or student experience, or creating an intimidating, hostile or
offensive working, academic or student life environment.

Harassment shall mean any act so severe, pervasive, and objectively offensive that it effectively

the victim’s employment and creates an abusive working environment. In determining whether
alleged conduct constitutes harassment as defined in this policy, the record as a whole will be
considered as well as the context in which the conduct occurred. Facts will be judged on the
basis of what is reasonable to persons of ordinary sensitivity and not on the particular susceptibility
of an individual, unless that susceptibility is known to the alleged harasser.

UNC System Policies - Freedom and Responsibility in the University Community 06-07
The University of North Carolina is dedicated to the transmission and advancement of knowledge and understanding. Academic freedom is essential to the achievement of these purposes. The University therefore supports and encourages freedom of inquiry for faculty members and students, to the end that they may responsibly pursue these goals through teaching, learning, research, discussion, and publication, free from internal or external restraints that would unreasonably restrict their academic endeavors.
(2) The University and each constituent institution shall protect faculty and students in their responsible exercise of the freedom to teach, to learn, and otherwise to seek and speak the truth.
(3) Faculty and students of the University of North Carolina shall share in the responsibility for maintaining an environment in which academic freedom flourishes and in which the rights of each member of the academic community are respected.
Computer Use Policy 06-07
Harassment is defined as a course of conduct that is directed at a specific individual or group of individuals
that causes emotional distress in such person(s) and serves no legitimate purpose. Such
actions include, but are not limited to, the following:
1. Interfering with the legitimate work of another user;
2. Sending abusive or obscene messages via computers; and,
3. Using of computer resources to engage in abuse of University personnel or other users.
