Sexual Harassment Policies (Learn More)

Sexual Harassment Policy and Procedures 08-09
Unwelcome sexual advances, requests for sexual favors, and other verbal
and physical conduct of a sexual nature constitute ʺenvironmental sexual
harassmentʺ when such conduct has the purpose or effect of creating an
intimidating, hostile, or offensive environment which unreasonably
interferes with anotherʹs work, academic performance, or privacy.
Facts will be judged on the basis of what is reasonable to persons of
ordinary sensitivity and not on the particular susceptibility of an
individual, unless that susceptibility is known to the alleged harasser.

Student Code of Conduct: Violations Under the Code 08-09
Violations of Respect may include but are not limited to:
Threatening or causing physical harm or harassment; hazing; non-consensual sexual acts; conduct which disturbs the peace of the community; trespass on University property or premises; conduct which is disorderly; infringement on the rights or property of members of the University community; failure to comply with directions of University officials; hate crimes, violation of a University No Contact Order; any act or omission that a reasonable, intelligent college student knows, or should know, infringes on the rights or property of members of the University community. Lack of intent or knowledge may be a mitigating factor in determining sanctions but does not excuse harm to person or property.

Stop the Hate: Definitions 08-09
A hate incident is an act of conduct, speech, or expression to which a bias motive is evident as a contributing factor (regardless of whether the act is criminal). [...] Hate incidents include, among other things, speech that is hate- or bias-motivated but is not a credible threat (like someone shouting an epithet out of the window of a passing car on a crowded street in the middle of the day), written hate statements that are not credibly threatening and are not vandalism, drawings that are not vandalism (for instance, something drawn on a chalkboard), and so on.

The University of North Carolina at Greensboro values freedom of speech as one of the fundamental rights guaranteed by the U. S. Constitution and as the best means for arriving at truth and mutual understanding. Peaceable assembly and the right to petition the government for a redress of grievances are also rights guaranteed by the First Amendment and are concomitant to the right of free speech.
