    Speech Code Category: Harassment Policies

    It is the policy of Nicholls State University that no member of the academic community may harass another member on the basis of his or her race. Disparaging remarks, the use of offensive epithets, general statements about racial characteristics, etc., constitute harassing conduct when:
    • They are unwelcome;
    • They are repeated frequently;
    • They imply a discriminatory attitude or hostility towards an individual because of his or her race or towards an entire racial group;
    • They are severely abusive and repeated so often as to create an atmosphere of hostility;
    • They have either the purpose or the effect of interfering with the victim’s academic or work performance or creating an intimidating, hostile, or offensive learning or work environment.
    • A single offensive remark, however hurtful, may not constitute racial harassment
    • Nevertheless, the University strongly disapproves of any such conduct, and will take action.

    It is the policy of Nicholls State University that no member of the academic community may sexually harass another. Sexual advances, requests for sexual favors, disparaging remarks and other conduct of a sexual nature constitute harassment when: (one or more of the following)
    * They are unwelcome;
    * They are made under circumstances implying that one’s response might affect academic or personnel decisions that are subject to the influence of the person making such proposals;
    * Such conduct is persistently abusive of others and implies a discriminatory attitude or hostility toward their personal or professional interests because of sex; or
    * Such conduct has the purpose or effect of unreasonably interfering with an individual’s academic or work performance or creating an intimidating, hostile, or offensive learning or work environment.
    * Examples of such conduct include unwanted touching, repeated negative comments about the abilities of one sex or another, repeated personal questions of a sexual nature, repeated sexually oriented comments about an individual’s appearance.
