Charges Against Pentagon Paper Leakers Are Dropped

A mistrial is declared and the charges against Daniel Ellsberg and Anthony Russo for violating the Espionage Act by leaking the Pentagon Papers are dropped on the grounds of government misconduct. Events that contributed to this include White House operatives breaking into Ellsberg’s psychiatrist’s office and the Federal Bureau of Investigation wiretapping Ellsberg.

In dismissing the charges, Judge William Matthew Byrne, Jr. states, “[t]he totality of the circumstances of this case which I have only briefly sketched offend a sense of justice. … The bizarre events have incurably infected the prosecution of this case.”
