Gender-Based Harassment includes harassment based on gender, sexual orientation, gender identity, or gender expression, which may include acts of aggression, intimidation, or hostility, whether verbal or non-verbal, graphic, physical, or otherwise, even if the acts do not involve conduct of a sexual nature. Such conduct creates a hostile environment. A “hostile environment” exists when the conduct is sufficiently severe, pervasive, and objectively offensive that is unreasonably interferes with, limits, or deprives an individual from participating in or benefiting from the University’s education or employment programs and/or activities. Conduct must be deemed severe, pervasive from an objectively offensive perspective. ... A hostile environment can be created by persistent or pervasive conduct or by a single or isolated incident, if sufficiently severe.

EXAMPLES OF SEXUAL HARASSMENT AND OTHER PROHIBITED CONDUCT

D. Unwelcome sexual advances, repeated propositions or requests for sexual relationship to an individual who has previously indicated that such conduct is unwelcome, or sexual gestures, noises, remarks, jokes, questions, or comments about a person’s sexuality or sexual experience. Such conduct between peers must be sufficiently severe, persistent, or pervasive that it creates an educational or working environment that is hostile or abusive.
E. Explicit sexual pictures are displayed in a professor’s office or on the exterior of a residence hall door.
F. The use or display in the classroom or workplace, including electronic, or pornographic or sexually harassing materials such as posters, photos, cartoons or graffiti without pedagogical justification.
