Feminist Majority Foundation v. University of Mary Washington

January 19, 2018

U.S. Court of Appeals for the Fourth Circuit, Jan. 18, 2018

Amici: Cato Institute, Foundation for Individual Rights in Education, Nadine Strossen, National Coalition Against Censorship

Amici argued that the University of Mary Washington had not been deliberately indifferent to claims of harassment by the plaintiffs, who objected to anonymous, offensive posts about them on the now-defunct social media app Yik Yak. Amici argued that the speech in question was constitutionally protected speech that did not rise to the level of harassment or threats, and that in any event, the university had responded adequately to plaintiffs’ concerns.
