Amici argued that the University of Mary Washington had not been deliberately indifferent to claims of harassment by the plaintiffs, who objected to anonymous, offensive posts about them on the now-defunct social media app Yik Yak. Amici argued that the speech in question was constitutionally protected speech that did not rise to the level of harassment or threats, and that in any event, the university had responded adequately to plaintiffs’ concerns.
