Enacted Campus Due Process Statutes

FIRE supports legislation that promotes fair and reliable non-academic campus disciplinary hearings on college campuses. We also work with policymakers to defeat measures that would further undermine fundamental fairness and to promote those that ensure that the campus judiciary provides meaningful due process protections to students accused of infractions.

Enacted Campus Due Process Statutes

Some states have enacted legislation to protect the due process rights of college students in campus disciplinary proceedings. This page lists the states that have done so. Click on a state for more information on its campus due process legislation. Students should also consult their state’s Administrative Procedures Act, as some of those laws grant students the right to have their disciplinary cases considered in a state administrative law hearing.
