Sexual harassment is a form of discrimination and violates this policy. Sexual harassment is conduct on the basis of sex that falls within the definitions below for quid pro quo or hostile environment. For complaints that fall within the definition of a Formal Title IX Complaint, the definitions of sexual harassment outlined in EWU Policy 402-07 (Title IX Investigations & Hearings) apply rather than the ones identified below.

b. Hostile Environment

Unwelcome sex-based conduct that, based on the totality of the circumstances, is:

  1. Subjectively and objectively offensive; and,
