Amici: Foundation for Individual Rights in Education, Institute for Free Speech

Amici argued that the district court erred in finding that Arkansas’ anti-BDS legislation — which requires anyone entering into a contract with the state government to pledge not to boycott Israel —  did not violate the First Amendment rights of the Arkansas Times, which refused to sign the pledge. FIRE and IFS argued that the type of boycott targeted by Arkansas’ law is a political boycott protected by the First Amendment.
