Case Overview

On September 10, 2025, the day of Charlie Kirk’s assassination, Texas Tech law student Ellie Fisher was working at a law clinic when two supervisors called Kirk a “piece of shit,” a racist, and a misogynist. Fisher did not respond to those remarks and only briefly discussed the assassination with other students, simply notifying the supervisors that the shooting happened and saying to students that the footage looked fatal. On September 13, Fisher posted about Kirk on Facebook, saying, “He was a Nazi.” Three days later, administrators sought a meeting with Fisher, alleging she “announced” the assassination in an “overexuberant” manner. On January 23, the matter was referred to the Honor Council for a violation of “professional duties.” On February 17, FIRE wrote TTU Law, notifying them that Fisher’s speech on Kirk was core political speech protected by the First Amendment and urging the council to end the investigation and clear her file of all references to this matter.
