By law, sexual advances, requests for sexual favors and other verbal or physical conduct of a sexual nature constitute sexual harassment when: … Such conduct has the purpose or effect of substantially interfering with an individual’s performance or creating an intimidating, hostile or offensive employment or educational environment.

Harassment may … be implied by unwelcome physical contact; sexual remarks about a person’s clothing, body or sexual relations; conversations or jokes and stories of a sexual nature; or the display in the work place or use in the classroom of sexually explicit materials which are inappropriate or without defensible educational purpose. Such acts are more likely than not to result in allegations of sexual harassment.
