Any unwelcome expressive, visual, or physical conduct including, but not limited to, bullying, cyberbullying, stalking, cyberstalking, threats, and intimidation when: … 3. Such conduct has the purpose or effect of unreasonably interfering with an individual’s work, educational performance, or status; or 4. Such conduct has the purpose or effect of creating a hostile environment. A hostile environment is one which is permeated with discriminatory intimidation, ridicule, offensiveness, or insult that is sufficiently severe or pervasive to interfere with an individual’s academic or work performance. In order to constitute a violation of this clause, a hostile environment must be subjectively perceived by the complainant and that perception must be reasonable for a person in the complainant’s position
